Former President Trump's Administration Seeks High Court Approval to Dismiss Top Intellectual Property Official

The former president's administration on Monday petitioned the nation's highest court to allow the termination of the director of the American copyright authority.

This urgent request follows about six weeks after a national appeals court in Washington decided that the director, Shira Perlmutter, could not be solely dismissed.

Nearly four weeks prior, the entire District of Columbia appeals court refused to reconsider that decision.

This legal matter is the most recent in a series of disputes related to presidential authority to place preferred heads at federal agencies.

The Supreme Court has generally permitted such dismissals, even as court challenges continue.

However, this particular case involves an office inside the national library. Perlmutter serves as the register of copyrights and also counsels the legislature on intellectual property matters.

The solicitor general, D John Sauer, argued in the filing that, despite connections to Congress, the director “wields administrative power” in regulating copyrights.

Perlmutter claims she was fired in May because the former president disapproved with advice she gave to Congress in a document related to artificial intelligence.

She allegedly received an message from the administration informing her that her role was “ended effective immediately,” as stated by her office.

A split appeals court group decided that Perlmutter could keep her position while the legal dispute moves forward.

“The administration's claimed obvious meddling with the work of a Legislative Branch officer, as she performs statutorily approved duties to counsel Congress, appears to be a breach of the division of government authority,” stated Judge Florence Pan for the appellate panel.

Justice J Michelle Childs supported the ruling. Both judges were appointed to the appellate court by Democratic leader Joe Biden.

In opposition, Judge Justin Walker, a former president's nominee, wrote that Perlmutter “exercises administrative authority in a host of manners.”

Perlmutter's lawyers have contended that she is a renowned copyright specialist. She has acted as register of copyrights since ex- head librarian Carla Hayden appointed her to the role in October 2020.

The former president named assistant attorney general Todd Blanche to succeed Hayden at the national library. The administration had dismissed Hayden following complaints from conservatives that she was promoting a “progressive” agenda.
